Surrogacy laws in Idaho

Idaho does not have a comprehensive gestational-surrogacy statute creating one uniform statewide pathway for agreements and parentage.

What the legal framework looks like

This page does not characterize Idaho as “surrogacy-friendly” or assume that compensated gestational-surrogacy agreements are uniformly recognized under a single statute. The governing agreement and parentage strategy should be reviewed under current Idaho law.

Parentage procedure

The availability, timing and form of any parentage order should be confirmed for the specific case with Idaho reproductive counsel. Do not assume that a pre-birth order or a particular birth-record result is automatic.

Agreement and medical autonomy

The agreement should address compensation and expenses, insurance, medical autonomy, legal costs, termination provisions and dispute procedures. A surrogate remains the patient for her own medical care; contractual terms should be reviewed accordingly.

What this means for a surrogate

Before signing an agreement or beginning treatment, use independent Idaho counsel to confirm the governing law, jurisdiction, parentage plan and enforceability of the proposed contract terms.

Confirm the legal pathway before you sign.

Use state-specific counsel for the agreement and parentage plan.
