Current legal framework
Kentucky does not have a comprehensive modern gestational-surrogacy act comparable to states classified green. Contract terms, compensation and the parentage strategy should therefore be reviewed under current Kentucky law before the parties proceed.
Pending legislation
Legislation concerning commercial surrogacy has been introduced in 2026. A proposed bill is not current law unless and until it is enacted and takes effect, so it should not be used as the basis for describing the present legal status.
Parentage procedure
The availability, timing and form of a parentage order should be confirmed for the specific case with Kentucky reproductive counsel. Do not assume that a particular pre-birth order or birth-record outcome is automatic.
Agreement and compensation
The agreement should address compensation and expenses, insurance, medical autonomy, legal costs, termination provisions and dispute procedures. The enforceability and treatment of those provisions require state-specific legal review.

Before signing an agreement or beginning treatment, use independent Kentucky counsel to confirm the governing law, parentage strategy and contract terms for the proposed match.
