Limited / fact-dependent framework

Surrogacy laws in Ohio

Ohio does not currently have a comprehensive gestational-surrogacy statute creating one uniform statewide pathway for agreements and parentage.

What the legal framework looks like

Because Ohio lacks a comprehensive gestational-surrogacy statute, parties should not assume that contract formalities, eligibility rules or parentage procedures used elsewhere automatically apply statewide.

Parentage procedure

The availability, timing and form of a parentage order should be confirmed for the specific case with Ohio reproductive counsel. This page does not rank counties or imply that any particular county guarantees a pre-birth order or birth-record result.

Agreement and compensation

The agreement should address compensation and expenses, insurance, medical autonomy, legal costs, termination provisions and dispute procedures. Enforceability and treatment of those provisions should be reviewed under current Ohio law.

What this means for a surrogate

Before signing an agreement or beginning treatment, use independent Ohio reproductive counsel to confirm the governing law, jurisdiction, parentage strategy and contract terms for the proposed match.
