Surrogacy laws in Oklahoma

What Oklahoma law provides

The Oklahoma Gestational Agreement Act establishes a detailed statutory process. Among other requirements, parties must meet age and relationship conditions, the agreement must be in writing, and validation requirements apply before the arrangement proceeds under the Act.

What the green classification means: Oklahoma has a comprehensive statute addressing gestational agreements. It does not mean every intended-parent or carrier configuration qualifies under that statute.

Important eligibility conditions

The Act contains specific rules for intended parents and carriers. For example, where there are two intended parents, the statute requires them to be married to each other, and if an intended parent is married, that spouse must participate as an intended parent. Other statutory conditions also apply.

What this means for a prospective carrier

Independent Oklahoma reproductive counsel should confirm that the proposed match and agreement fit the Act before medications or embryo transfer. A statute-based framework adds structure, but compliance with the statute is what matters.
