Oregon enacted major parentage and gestational-surrogacy changes in 2025, and some of the new provisions become operative on January 1, 2027.

What prospective gestational carriers should know

Do not treat every provision appearing in the current Oregon statutory compilation as operative today. The code itself identifies sections whose amended text becomes operative January 1, 2027.

What to verify before proceeding

  • Which version of each relevant parentage or surrogacy provision is currently operative.
  • The written agreement requirements that apply on the date of execution.
  • How and when a parentage judgment may be obtained.
  • Independent legal counsel, insurance, compensation and expense provisions.
  • Whether a professional summary is describing current law or the January 2027 framework.
