What Texas law provides
Texas Family Code §§160.751–160.763 authorize and regulate gestational agreements. The statutory framework addresses the agreement, court validation and establishment of the parent-child relationship when the statutory requirements are satisfied.
Eligibility and validation matter
The statute contains specific eligibility conditions for the intended parents and gestational mother and requires judicial validation. The current statutory route includes a marriage requirement for the intended parents. That is a marital-status condition; the statute does not state that the intended parents must be a heterosexual couple.
What this means for a prospective carrier
Before signing or beginning treatment, Texas reproductive counsel should confirm that the parties, agreement and validation proceeding satisfy the statute. Do not rely on county rankings or assumptions that a particular court outcome is automatic.
